Clarification about Death Move-out Procedure

Confusion often arises when processing move-outs following the death of a sole tenant. To ensure compliance with HUD requirements and prevent subsidy overpayments, follow these key guidelines.

Key Rule:
HUD requires subsidy to end on the earlier of:

  • 14 days after the tenant’s date of death, or
  • The date the unit is vacated.

Important Details:
If the move-out date is more than 14 days after death, record the actual date, but note:

  • Subsidy is only payable through the 14th day after death.
  • Any subsidy paid beyond that period must be returned to HUD.

Example Scenario:

  • Date of death: 5/1/25
  • Family vacated unit: 5/31/25
  • Subsidy ends: 5/15/25

Critical Reminder:

  • Do not submit Terminations for sole tenant deaths.
  • Process these only as Move-Outs (MO) in TRACS.
  • Following this procedure ensures compliance and prevents incorrect subsidy claims.
